1. Submission of Content
1.1. Procreate (meaning Savage Software Group Pty Ltd and its associated entities) is running Procreate Pop-Up Tokyo, taking place in Tokyo, Japan, from 3rd – 6th April 2025 (referred to in these terms as “the Event”).
1.2. Procreate plans to display a range of artwork and animations at the Event location during the Event.
1.3. Procreate invites submissions of original artwork and animations made using Procreate, Procreate Pocket, and/or Procreate Dreams (referred to in these terms as “Content”) through the submission portal located at procreate.com
1.4. Submissions must be received before 5pm 6th April 2025 (JST) to be considered for display during the Event.
1.5. There is no fee for submission, and you may make more than one submission. However, you must not submit the same piece of work more than once.
1.6. The display of the selected Content will be accompanied by the name and/or social media tag you provide for the creator of the Content.
2. Personal Information and Privacy
Procreate’s
Privacy Policy will apply to all personal information collected through the submission process. By submitting your Content, you provide your consent for Procreate to use, store, and disclose the information you provide in accordance with this Privacy Policy.
3. What can Procreate do with my Content?
By submitting your Content, you agree that Procreate may, but is not required to:
a) Display your Content, including the name and/or social media tag you provide, during and at the Event.
b) Capture and use recordings or photographs of your Content as displayed at the Event for use in promotional and other materials online, including on Procreate’s website and social media accounts.
c) Share your Content, including the name and/or social media tag you provide, online including on Procreate’s website, social media, and YouTube channels.
4. Representations About Your Content and the Information You Provide
4.1 By submitting your Content, you warrant and agree that:
a) You are 18 years of age or older as at the date of your submission.
b) You are not a resident of an Australian-sanctioned country.
c) You have not submitted and will not submit any data, file, software or link that contains or redirects to a virus, Trojan horse, worm or other harmful component.
d) The information you provide to Procreate in relation to you and your Content is true and correct.
e) The Content was made using a Procreate product.
f) Once you have completed the email confirmation step of the Content submission process, you may not withdraw your consent for Procreate’s use of your Content.
g) Procreate may retain a copy of your Content after the Event for internal business purposes.
h) Procreate may use the contact details you provide to contact you in relation to future collaboration opportunities.
i) You are not entitled to any financial compensation for the submission of your Content or Procreate’s use of your Content.
j) You are making a representation that either you are the sole creator and owner of the Content, or you have the necessary consents and/or intellectual property rights in the Content to allow Procreate to use the Content as described in these terms.
k) If you are not the creator of the Content, you are providing the applicable credit for the creator of the Content to be used in the display at the Event.
l) Procreate’s use of the Content as set out in these terms will not infringe the rights, including intellectual rights, of any person.
4.2 You warrant and agree that your Content is not, and, where applicable, could not be construed as being:
a) AI-generated (including any component of the Content);
b) violating any law;
c) giving rise to any civil, criminal or other liability;
d) impersonating another person;
e) representing or referencing illegal drugs, weapons, gambling or other illegal substances, items or activities;
f) encouraging, promoting or condoning any illegal behaviour;
g) sexually descriptive, demeaning or discriminatory;
h) political;
i) racial;
j) abusive;
k) derogatory;
l) malicious;
m) disrespectful;
n) misleading;
o) deceptive;
p) hateful;
q) defamatory;
r) obscene
s) threatening;
t) abusive;
u) harassing;
v) harmful;
w) invasive of anyone's privacy;
x) pornographic;
y) excessive, extreme or gratuitous sexualisation; or
z) excessive, extreme or gratuitous violence.
4.3 You warrant and agree that you will provide compensation to Procreate for any loss Procreate suffers arising out of or in any way connected to any breach of these terms, including in relation to or in connection with any breach of intellectual property rights in relation to your Content (for example, if Procreate receives a claim that the Content was created by or has been exclusively purchased by someone else).
5. Governing law and jurisdiction
The laws of Tasmania, Australia govern these terms and the parties submit to the non-exclusive jurisdiction of the courts of Tasmania, Australia.
